Trump administration lawyers say trans troops won’t be discharged as long as they identify with biological gender

They argued that not all transgender people undergo gender confirmation surgery

The Trump administration has revealed transgender troops will not be discharged as long as they identify with their biological gender.

The bigoted President of the United States revealed in a Twitter post back in July 2017 revealing he planned on banning 15,000 transgender military men and women and although federal judges blocked his plan, the case was back in court this week.

On Monday (December 10), lawyers for the Trump administration appeared in court to address Trump’s proposed ban.

During the hearing, they revealed that transgender troops would not be discharged based on their trans identity, The Daily Beast reported.

However, the court clarified the new version of the policy states troops must identity with their biological sex meaning trans people can serve as long as they do not undergo any medical care.

Judge Thomas Griffith said: “As I understand it, you’re saying there are transgendered individuals in the military who can serve consistent with their biological sex.

“But don’t they have to suppress the very nature of their transgender condition to do that?”

However, the Department of Justice Attorney Brinton Lucas argued that numerous people do not undergo any medical transitions for their gender identity.

He said: “There are some transgender individuals who identify as non-binary or genderfluid and so the concept of gender transition has no meaning for these individuals.”

The director of the LGBTQ Legal Advocates and Defenders’ Transgender Rights Project, Jennifer Levi said: “The reality is that transgender people sometimes don’t transition or transition later in life because of discrimination and social pressures.

“And they certainly shouldn’t have to face that kind of discrimination from their country when all they’re seeking to do is serve.”
